Italy: Repression news round-up and Juan’s communique – August 2019

(it-en-fr-es) Italia: Operazione Prometeo – Riferimenti per benefit e aggiornamenti

Italy: Prometeo Operation – References for benefits and updates

Natascia, Robert and Beppe were arrested on May 21st 2019. They were accused of sending three explosive packages in 2017 to the PM (public prosecutor) Sparagna and Rinaudo, and to Santi Consolo, who was the director of the DAP (Department for the Penitentiary Administration) of Rome. More information is available here.

Natascia has been imprisoned in the jail of L’Aquila, in the AS2 (high security) section, which is actually a 41-bis section. Anna, another comrade, is also imprisoned in this section. She was arrested in 2016 following a repressive operation called SCRIPTA MANENT. Silvia is still being held in the jail of Turin (Torino) where she was transferred in order to be present for minor trials. Natascia began a hunger strike while she was in the jail of Rebibbia (in Rome), in solidarity with Anna and Silvia who began a hunger strike to demand the closing of the AS2 section in L’Aquila. All the three of them ended the hunger strike on June 28th (Anna and Silvia maintained the hunger strike for one month). Right after the end of the hunger strike, after almost 6 weeks of detention, Natascia received her first visit in jail. On July 11th, the re-examination hearing was held, which Nat was only allowed to attend by video conference.

On July 30th Natascia has been transferred to the jail of Piacenza.
For more info go to: 1, 2, 3.

Robert was moved from the jail of Terni (Umbria) to the jail of Sassari (Sardinia) on July 6th. His detention conditions have definitely gotten worse due to the geographic isolation, which keeps him far away from his family, friends and lawyers. Before his detention in the jail of Terni, he was being held in the Opera jail (Milan), known for its horrible detention conditions. While there, he was kept in solitary confinement for one month, except for one hour a day. When he was moved to Terni, the detention conditions were better: there was no more solitary confinement, better food, a few hours everyday to socialize with other political prisoners, some time to spend in an inner yard, a library and a gym. On July 18th, there was a solidarity blitz to say hello to Robert and to the other prisoners of the Bancali-Sassari jail [1].

Beppe was kept in solitary confinement for more than one month in the jail of Opera, except for an hour a day of permitted socialization and then again in the jail of Alessandria. In Alessandria, he was kept in solitary during the few hours a day when he was out of the cell, even though the prosecution hadn’t requested this and despite the fact that there is an AS2 section available. He held a hunger strike to protest his imprisonment conditions for some days at the end of June. On July 8th, we were told he had been transferred to the jail of Rossano Calabro (Calabria). Once again, a comrade was moved to an isolated jail in an isolated location, far from his family, friends and lawyers.

We have to wait until September or October for another legal re-examination of their case.

From today, there will be two different ways to send economic contributions in solidarity to Natascia, Robert and Beppe. You can send your contributions to either of the platforms as they are in contact and coordinating the funds together. The money will be used to help cover their expenses in jail, their legal expenses, the travel costs of friends/relatives who travel to visit them in jail, and any other expenses concerning their imprisonment.

Again, we encourage all comrades (also in support of what they’re writing to us from jail) to express your solidarity by sending letters and books to the prisoners. Their mail is undergoing “political censorship”, which means that some letters may not be received and others may take longer than average to reach their destination. PLEASE DO NOT GIVE UP! Keep writing! Solidarity warms and cheers up prisoners and their close comrades.

(it-en) Italia: Natascia, arrestata per l’operazione “Prometeo”, è stata trasferita nel carcere di Piacenza

Italy: Natascia, arrested for the “Prometeo” operation, was transferred to the prison of Piacenza

We learn of the transfer, which took place on July 30th, of the anarchist Natascia Savio from the prison of L’Aquila to that of Piacenza. Natascia was arrested on May 21st 2019 in the context of the repressive operation “Prometeo” (“Prometheus”) along with two other comrades, Robert e Giuseppe. The last two have also recently been transferred further, respectively to the prisons of Bancali (Sassari, in Sardinia) and Rossano Calabro (province of Cosenza).

We recall that the main accusation against the comrades is of “attack with the purpose of terrorism or subversion”, as they are held responsible for sending three bomb packages arrived in June 2017 to the public prosecutors Rinaudo (prosecutor in several trials against the antagonist movement and the anarchists) and Sparagna (prosecutor in the trial for the “Scripta Manent” operation) and Santi Consolo, at the time director of the DAP (“Department of Penitentiary Administration”) in Rome. They are not accused of any “associative” crime (such as articles 270 or 270bis, penal code).

Following the transfer of Natascia to the prison of Piacenza, only the anarchist comrade Anna Beniamino (arrested in September 2016 for the “Scripta Manent” operation and sentenced to 17 years in prison in April this year) remains detained in the section AS2 of L’Aquila, a section against which the anarchist prisoners held there carried out the hunger strike from 29 May until the very last days of June, which were also joined by other comrades in other prisons.

(it-en-fr) Italia: Processo “Panico” – Considerazioni tecniche rispetto alla sentenza del 22 luglio 2019

Italy: “Panico” trial – Technical considerations about the sentence of July 22nd, 2019

In essence, much has remained unchanged from the requests of the pm, some of the sentences are even worse.

These are the substantial differences / considerations at a glance:

The qualification of the new year charge as attempted murder did not pass, but was downgraded to serious injuries; however this did not result in much difference in sentencing from that requested. The lethality of the device was still accepted. Giova, Ghespe and Paska were sentenced for the new year, while another accused was acquitted of that charge.

The charge of criminal association passed, but 6 (out of 15) of the “associates” were acquitted. 2 comrades were confirmed “heads” of the association, while the accusation against Giova of having become the new “head” following the two’s arrest after the first wave of precautionary measures, was not accepted.

The gathering in Sollicciano saw the acquittal of all the defendants en bloc, probably because, unlike that of April 25, the prosecution had not managed to get any details of those who organised it. In fact, as can be seen from the convictions for the Sant’Ambrogio demo, those sentenced for unauthorized demonstration are the two people who used the megaphone; for April 25, the two charged while talking about an intervention to be done at the gathering. The other acquittals concern people who were not recognized by witnesses or surveillance cameras at the trial.

As for the convictions, the associated have been given a minimum of 2 years. It would seem that they have come down particularly hard, often above the expectations of prosecutors, for charges related to the events of Melograno.

In any case, we will not know with certainty what passed and what didn’t before the reasons for the sentence are filed. I think it’s obvious, though, that DNA has been fully accepted as incriminating evidence for Ghespe, and that things could hardly have gone worse. On the other hand, the feeling was that this sentence had already been written a long time ago.

Ghespe: 9 years.
Giova: 9 years, 10 months and 15 days.
Paska: 9 years and 10 months.
For all the others, the sentences go from one month to 6 years.

The deadline for filing the reasons is 90 days.
The prison sentences are suspended except for Paska, Ghespe and Giova who are already under house arrest.

(it-en) Italia: Aggiornamenti sulla situazione dell’anarchico prigioniero Alfredo Cospito (24/07/2019)

Italy: Update on the Health Situation of Imprisoned Anarchist Comrade Alfredo Cospito (July 24th, 2019)

Comrade Alfredo Cospito started feeling unwell 15 days ago, right after his hunger strike ended. He immediately insisted on a CT scan. In fact, as soon as the CT scan was carried out, he was urgently transferred to the hospital where he was operated on. The operation went for 5 hours as they had to remove his gallbladder, which had ruptured. All this because the doctors had been saying for months that it was necessary to operate, but the prison kept postponing, trying to solve the problem with tablets, which in reality did not solve anything. The situation got worse with the hunger strike.

Alfredo’s family only learned of his transfer to hospital and the operation four days later. A week after the operation he was transferred back to prison. At visits he was very physically exhausted, in a wheelchair and very thin.

During his hospital stay he was placed in a room with an armored door, cameras and at least three guards at all times, with nothing – no books or a clock, losing track of time passing. After three days he managed to get some books he had back in the prison.

Three days ago a call from Alfredo’s lawyer informed his family that he had again been transferred to the hospital for intensive surgery.

After leaving hospital the first time Alfredo developed an infection of the pancreas caused by a cyst that had started to spread. Now the situation is stable and improving. Alfredo is in good spirits.

This time the doctors have declared that they will not discharge him until he is completely healed.

It is clear that his return to prison after the first operation was hastened because the prison authorities consider him to be dangerous and they were paranoid about a possible escape attempt. So the doctors were pressured into releasing him early.

Now he has some books, but we are trying to make sure that he gets mail and a change of clothes at the hospital, he has been wearing the same clothes for days and he has had to wash them himself, keeping the drip on one arm and using his other arm to wash.

More updates soon.

(it-en) Italia: Aggiornamento su Divine

Italy: Update about Divine

On Monday, July 15th, at around 1.00 pm the police showed up at the home of anarchist comrade Divine to take him to the police station, where he was notified of an expulsion order signed directly by the minister Matteo Salvini. Although he had lived in Italy for twenty years and had all the necessary papers for his stay, the judge validated the expulsion measure by appealing to various complaints, including an accusation with the aggravating circumstance of terrorism from which he was acquitted years ago. On July 16th, deportation in Nigeria was scheduled, but this didn’t happen, also following a decision of the “European Court of Human Rights”. However, the kidnapping of the comrade continued and on July 16th he was imprisoned in the CPR (prison for migrants and people without papers) of Bari, from which, finally, he was released from prison on July 19th.

A communique from Juan from the prison of Terni

‘Those who have ears to hear, let them hear!!!’
Arise, ye workers from your slumber,
Arise, ye prisoners of want.
For reason in revolt now thunders,
and at last ends the age of cant!
Away with all your superstitions,
Servile masses, arise, arise!
We’ll change henceforth the old tradition,
And spurn the dust to win the prize!.

The Internationale – song born of poet and anarchist Eugène Pottier in 1871

Hi to all friends and comrades!! I’m Juan arrested on 22nd May after three years on the run. I’m writing from the AS2 unit of the prison of Terni, where I’m locked up. I’m calm, my morale is stable and I’m determined to move on.

Each day I was in hiding I was well aware that I could end up in jail; after all I’ve always been there, since the day I decided to struggle on the side of the oppressed.
My capture was due to a lack of a series of precautions that I normally took. I lowered my guard at the wrong time in the wrong place.

I have no regrets, I accept my responsibility, I’m getting over it and might it be a lesson. I’ll write about how my capture took place some other time.

But first I’m going to explain my judicial situation so as to give the general picture. I’m in prison because of two lines of investigation. The first concerns a consecutive sentence of nine years (three of which I have already served) linked to my struggle/life of the last twenty years spent in Italy.

The convictions are for various offences including theft, resistance, robbery, contempt, damage, occupation of public and private places, assault, false identity. Among these final convictions there is also that of the NO TAV ‘Big Trial’ (three years and nine months), which I’ll make some points about some time in the future as an accused Anarchist.

Knowing that some of these sentences would come into effect, I spent three years on the run (and not because of the investigation concerning an attack on the POL GAI [police training centre] in Brescia, as the magistrates insist). With no regrets I claim my escape as an act of reconquering my freedom, which goes beyond all authority and law.

In the second line, which began during my time in hiding, I am accused of articles 270, 280, 285 (massacre) and am accused of two attacks. The first against the POL GAI (police training centre) claimed by the acca cell in the context of black December in 2015. The second attack, on 12\08\2018, concerns two explosive devices, one which exploded and the other full of wooden nails, found by bomb disposal experts and intended to be a trap to attract the occupants of the building and the forces of order; these were placed at the premises of the Northern League of Treviso and claimed by the Haris Hatzimihelakis\Black International 1881\2018 cell. I wasn’t aware of this investigation until the day of my capture, contrary to what the judges are saying in order to worsen Manu’s custodial situation, as he is accused of aiding and abetting. However we are waiting for a more complete picture as soon as the investigation closes.

Already a quick reading of the DIGOS and prosecutors’ preliminary investigations gave me an idea of what they want to repress. Specifically against me as an Anarchist and generally against the anarchist reality as a whole. Nothing new that hasn’t been already done by judges in all sorts of ways. To recognize repressive intentions is a guide to understanding what they actually want to strike and consequently how to move.

(From this point on, words in inverted comas are taken from the papers of the preliminary investigation)

According to the investigation, the claims of the two attacks are allegedly linked to an interview with Alfredo Cospito in the Anarchist paper Vetriolo 2019 and are supposed to represent “the same contents and the same operational lines”… as if there were orders from above. Charges are allegedly in cooperation with the usual unknown, because besides my DNA, partially identified, there would be another unknown DNA belonging to my presumed accomplice. On the one hand, associative crimes are brought into play, on the other I would be the only deviser, organizer and perpetrator. In other words, neither fish nor fowl.

My cynical jokes aside, it is clear there is an obvious intention by the magistrates, with their aberrant state ideology, to fabricate devisers-leaders in the anarchist reality, with operational lines to be followed and hierarchical structures. A strategy adopted in this specific case as well as in recent investigations that have struck anarchist realities. In this case, Alfredo is allegedly “one of the most important and recognised exponents of the terrorist movement of an Anarchist background currently imprisoned in the prison of Ferrara serving a sentence inflicted for the attack on Engineer Adinolfi”.

The state and the law (as usual) would like to make the accusations worse by fabricating leaders of an imaginary hierarchical terrorist organization, so as to manipulate and unify everything in one single inquisitive cauldron and throw the ‘representatives’ of the anarchist galaxy into it. In this way they are trying to create a spectacular atmosphere, they are preparing the ground to make scorched earth and eliminate any autonomous instances and direct action in the anarchist struggle.

But there is more. The judiciary would like to incorporate the practice of anonymous direct action by including such actions in the investigation “even if claims of specific acronyms (the action was claimed by so called haris hatzimihelakis\black international 1881\2018 cell) are not considered essential in the context of anarchist initiatives which also accept anonymous initiatives with similar initiatives and with the modalities already used in other attacks attributed to the FAI/FRI group. So the intention is to create precedents for anonymous actions of attack by including them in the various investigations when this suits them most, so that they can fabricate their imaginative terrorist organizations with leaders created ad hoc. Moreover the aspect of solidarity with anarchist prisoners and those who are locked up or generally those who revolt, is emphasized.

These are the key points that they linger over and which they want to strike and silence, because they represent the bases with which anarchists continue to support certain practices publicly (there are some anarchists under investigation for various publications and sentenced to years in prison). In this investigation, as in all those underway against anarchists, they want to repress the basic concepts of anarchist theory and action, such as refusal to delegate, direct action, solidarity with revolutionary prisoners, multiform non-hierarchical practices of attack and permanent rebellion averse to all forms of authority.

In this way power is telling us indirectly that these basic concepts remain qualitatively blunt if they are not accompanied prospectively with a projection into the struggle alongside the exploited; it is here that they are striking us preventively.

We need to have a common vision and feeling which includes the individual and the collective in an alchemy of local and specific struggles (as anarchists) intended as tactics of different and diversified struggles which are however born and recognize themselves in the whole of the general struggle and in the wealth of its methodological and projectual diversity. Which constantly needs to be in equilibrium with an internationalist perspective and harmonized in the chaos of infinite tactics and strategies of anarchism which flow into the universal struggle for anarchy. All this seasoned with the fundamental essence of Anarchy; universal solidarity at every level of the struggle/life.

The state is playing this game in order to strike us harder and to reaffirm that there can be no form of social organization other than the authoritarian and hierarchical one of today’s society.

Revisionism of the past is a powerful weapon that states use to disempower the various forms of revolt of the present time and create a void around today’s revolutionaries leaving them without roots or soul. That is why it is important to not forget but to propagate past epochs, and treasure the memory of our comrades’ struggle as a stimulus for the struggles of today.

A glance at our past is enough to realize that certain tensions and methods have always been used in the anarchist struggle, even before the birth of the antiauthoritarian international in 1871.

I claim these fundamental principles head held high! I refuse any theorem that they want to pigeonhole me in contrary to my most basic principles as an anarchist.

And here it is not a question of saying that the struggle is non-violent or of passing oneself off as angels or pious souls. It is a question of calling things by their name and claiming the instances of struggle that anarchists, rebels and revolutionaries use and have always used all over the world.

I have said all this openly and publicly ever since I chose to struggle through my special conception of anarchism. Regardless of whether I am responsible for the deeds I am accused of or not, I share and am in in solidarity with the struggle and the actions of attack on capital and the state. Which by its very nature is always responsible for the massacres and genocides all over the world.

“We must fight and fight for disproportion to be crushed”

And whatever path we take, always with our hearts!

For Anarchy!

Juan let us know by letter that he’s receiving all the letters written to him, even if the censorship is pretty hard. However, he is having problems in sending replies and is asking for a bit of patience in receiving them and to not be discouraged by the silence. For the rest, he says he’s calm and doing well.
